1. Agreement to Terms
By accessing or using BuildTrack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
BuildTrack provides a cloud-based construction management platform including project tracking, resource management, document storage, and collaboration tools. Features vary by subscription tier.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your use complies with applicable laws
- Obtaining necessary permissions for data you upload
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any systems
- Interfere with other users' access to the Service
- Upload malicious code or harmful content
- Reverse engineer or copy the Service
5. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice.
6. Service Level Agreement
For Enterprise customers, we commit to:
- 99.9% uptime (excluding scheduled maintenance)
- Response to critical issues within 1 hour
- Monthly uptime reports
- Service credits for SLA breaches
7. Data Ownership
You retain all ownership rights to the data you upload. We claim no intellectual property rights over your content. You grant us a limited license to process your data solely to provide the Service.
8. Limitation of Liability
To the maximum extent permitted by law, BuildTrack shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability is limited to the fees paid in the 12 months preceding the claim.
9. Termination
Either party may terminate this agreement with 30 days written notice. Upon termination, you will have 30 days to export your data. We reserve the right to suspend accounts for Terms violations.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bangalore, Karnataka.
